  • “Products” refers to all power generation, distribution, protection and security equipment, systems and solutions offered by Cerberus.
  • “Services” refers to engineering design, consultancy, installation support, commissioning and after-sales support provided by Cerberus.

By accessing or using our website, submitting an enquiry, or entering into any transaction with Cerberus, you confirm that you have read, understood and agree to be bound by these Terms of Condition and our Privacy Policy. If you do not agree, please discontinue use of the website immediately.

6. Quotations & Orders

Enquiries submitted via our website or email do not constitute a binding order. A contract for the supply of products or services is formed only when:

  • We issue a formal written quotation; and
  • You issue a signed purchase order or written acceptance; and
  • We confirm acceptance of your order in writing.

All quotations are valid for 30 days from the date of issue unless otherwise stated.

7. Pricing

All prices quoted are exclusive of applicable taxes (including VAT), customs duties, delivery and installation costs unless expressly stated otherwise. Prices are subject to change without notice prior to the placement of a confirmed order.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Cerberus shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, our website, products or services — including loss of profits, data, business or goodwill.

Our total aggregate liability to you for any claim arising out of or in connection with these Terms, whether in contract, tort (including negligence) or otherwise, shall not exceed the greater of: (a) the amount paid by you to us in the 12 months preceding the claim, or (b) USD 1,000.

The website and its content are provided on an “as is” and “as available” basis without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Cerberus shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, war, armed conflict, civil unrest, government action, sanctions, labour disputes, natural disasters, pandemics, or disruption to supply chains.

14. Governing Law & Jurisdiction

These Terms of Condition shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Ukraine, unless otherwise agreed in writing by both parties.

We reserve the right to update these Terms of Condition at any time. Changes will be effective upon posting to this page with a revised “Last updated” date. Your continued use of the website following any changes constitutes your acceptance of the revised Terms.
